Your use of the "Studio City Weather Center" web site (the "Site"), and all information, products, data contained on the Site (the "Data"), and services on the Site (the "Services"), are subject to the binding legal terms set forth below ("Terms"). We may update these Terms from time to time without notice. Unless we let you know by giving notice, any new features or updated Services we put on the Site will be subject to these Terms. By using the services, you agree to each of the Terms set forth below, You are not authorized to use the services for any other purpose.
We are pleased to give you access to this Site free of charge. However, in order to access the Site and Services, you will need to establish an account with an internet service provider ("ISP"). You will also need equipment to access the Site, including a computer, modem, or other communication device. In order to receive text message severe weather alerts, you must have a text-ready mobile communications device (cell phone or alpha-numeric pager), as well as an account with a wireless service provider to receive such communications. You agree to pay for all hardware and service costs need to access the Site and use the Services. "Studio City Weather Center" is not responsible for any of these costs.
You may use the Services on the Site for your personal, non commercial use. You may make a single copy of the individual screens you see when you use the Services, but only for your personal use. You cannot distribute or transfer the copies to others in exchange for money or other consideration. You may not modify, reformat, copy, display, distribute, transmit, publish, license, create derivative works from, transfer or sell any information, products or services obtained from the Services, except as set forth below. This means you may not mirror the home page or other pages of the Site on your website or webpage.
Except for allowing you to use the Site for your personal use as set forth in the paragraph above, when you use the Site, you are not receiving license or any other rights from "Studio City Weather Center", including intellectual property or other proprietary rights of "Studio City Weather Center" or other companies with which "Studio City Weather Center" is affiliated. You understand that you have no rights to the Services or any other "Studio City Weather Center" property except as we indicate in these Terms.
From time to time we receive requests to disclose the identities of our users. We do not disclose the identities of our users unless we are legally required to do so.
We will use commercially reasonable efforts to maintain the Site free of viruses and other harmful components. However, as the Site is accessible by third parties, we cannot assume any responsibility for any viruses or other harmful components that may affect your computer equipment or other property as a result of your access to, viewing of or downloading any Data from the Site. We do not warrant that the Site, its servers or any Data downloaded from the Site is free from viruses, bugs or other harmful components.
"Studio City Weather Center" strives to provide timely and accurate Data, however we cannot guarantee the Services will be free from technical malfunction or failure. While the best effort will be made to limit these instances and reasonable steps will be taken to inform you of the status of the Services, "Studio City Weather Center" cannot assume liability for untimely or inaccurate Data. THE SERVICES OF THE SITE ARE PROVIDED AS IS, WITH NO WARRANTIES WHATSOEVER.
UNLESS OTHERWISE NOTED, THE US GOVERNMENT AUTHORS AND ISSUES THE WATCHES, WARNINGS, ADVISORIES, ALERTS, STATEMENTS, AND BULLETINS THAT ARE RE-TRANSMITTED ON THIS SITE. IN NO WAY WILL "STUDIO CITY WEATHER CENTER" BE HELD LIABLE FOR FALSE OR MISLEADING INFORMATION CONTAINED IN ANY OF THESE RE-TRANSMITTED PRODUCTS. USER AND OTHER THIRD PARTIES ARE SOLEY RESPONSIBLE FOR ACTION OR LACK OF ACTION TAKEN TO PRESERVE LIFE AND/OR PROPERTY.
